Notarizing Doucements for Quadriplegic Persons
When a quadriplegic and blind man at Prestige Senior Living needed to transfer his car title to his brother, the task seemed impossible. The client’s brother, who had hired Idaho Mobile Notary, was at a loss as to how they could obtain the necessary signature and have it notarized. Faced with this unique and urgent challenge, Idaho Mobile Notary stepped in to find a solution that not only met the legal requirements but also provided the family with much-needed peace of mind.
Problem:

Finding a Solution
At Idaho Mobile Notary, we encountered a unique challenge when called to Prestige Senior Living at Karcher Estates. The client required a car title transfer to his brother but, due to his disabilities, was unable to physically sign the document. The urgency was heightened because they needed the vehicle ready for the quadriplegic brother as soon as possible.
To solve the problem, we referred to the Idaho Notary Handbook, which provided a solution through the “Signature by Third Party” rule (see below). This rule allows a third party to sign on behalf of an individual who is physically unable to do so, as long as both parties are present during the notarization.
When I arrived, I worked with the client and his brother, using this rule to facilitate the notarization. We ensured that all legal requirements were met, including the necessary modifications to the notarial certificate with the phrase, “Signature affixed by [Name] at the direction of [Signer].”

We carefully documented the process, taking IDs from both the client and the third party, and recorded the transaction in our electronic notary book. The correct notarial language was added, and the document was properly notarized.
The client and his brother were relieved and pleased that a solution was found to a problem they thought was unsolvable.
